General

The general ordering conditions apply to the legal relationships arising when ordering sports food and accessories through the ordering environment on the website www.enervit.ee (hereinafter referred to as the e-shop) of Enervit Estonia (hereinafter referred to as Enervit.ee).

In addition to these General Order Terms and Conditions, the relations between the Orderer and Enervit.ee are governed by the legal regulations in force in the Republic of Estonia, the e-store price list and established good practices.

1. Procedure for ordering products

1.1. To order products, the Customer does not need to register as a user of the Enervit.ee internet environment.

1.2. In the case of registration, Enervit.ee sends a letter to the e-mail address specified by the Subscriber with instructions for activating the user account.

1.3. After activating the user account, the subscriber can enter the Enervit.ee internet environment and place orders with user IDs specified by him.

1.4. The customer selects the desired products, specifies the required parameters for each product, if any, the method of payment and delivery, and confirms the order.

1.5. A delivery fee is added to the price of the ordered products according to the delivery method chosen by the Customer.

1.6. It is possible to pay for an order confirmed by the customer by payment order.

1.7. The order takes effect after the amount paid for the ordered products is received in the bank account of NutriMedical OÜ. Enervit.ee informs the subscriber about the entry into force of the order via e-mail.

1.8. Enervit.ee delivers the ordered products to the Customer in accordance with the method chosen by the Customer when placing the order: either through a parcel machine or the customer can pick up the goods himself at the Tallinn store. You can read more about editing here: “Transport”.

2. Subscriber’s rights

2.1. The customer has the right to order products in the e-store at the price set by Enervit.ee and under fixed conditions.

2.2. The goods sent to the customer must be correct and complete and meet the conditions set by Enervit.ee.

2.3. The customer has the right to submit claims regarding the product order and the product itself to Enervit.ee at Türi tänav 3, 11313, Tallinn or to the e-mail address info@enervit.ee within 30 days of receiving the shipment.

2.4. The customer has the right to cancel the order for products within 14 days from the time the order is placed until the delivery is received. To cancel the order, the Subscriber must submit a written or e-mail application to Enervit.ee at Türi tänav 3, 11313, Tallinn or to the e-mail address info@enervit.ee.

In the written application submitted to cancel the order, the Customer must indicate the bank account number and the holder where to transfer the money. enervit.ee does not make cash refunds. If the Customer withdraws from the order, the Customer undertakes to return the unused and undamaged products without delay, but no later than within 30 days of sending the cancellation request. Enervit.ee will return to the Customer the amount paid for the returned products, excluding shipping costs, no later than 30 days after receiving the cancellation notice and the products. Return costs are paid by the Customer. The goods to be returned must be in their original packaging, with tags and unused. If it is possible to exchange products, the shipping costs are paid by the Customer.

3. Obligations of the customer

3.1. When completing the order, the Customer is required to provide the necessary information for the execution of the order – first and last name, exact address (street, house no., district no., zip code, city/settlement/ or village/county), contact phone number in Estonia and e-mail address. The terms of delivery are valid only in the territory of the Republic of Estonia. If you wish to order abroad, please contact customer service.

3.2. In the event that the Customer and the recipient of the shipment are different, the Customer must provide in point 3.1. fixed data about the recipient as well.

3.3. In the event that the data provided by the Customer is incorrect and/or incomplete and does not comply with point 3.1. fixed light, Enervit.ee does not guarantee the proper fulfillment of the order. If possible, Enervit.ee will contact the Subscriber to clarify incorrect or incomplete data. The Customer is responsible for the delay of the goods if the wrongly and not clearly indicated destination address is not found.

3.4. By completing the order, the Customer confirms that he agrees with the conditions set forth in the ordering conditions and undertakes to fulfill them.

4. Enervit.ee’s rights

4.1. In the event that the Orderer does not fulfill the obligations imposed on him by the given ordering conditions, Enervit.ee does not guarantee the entry into force of the order and/or the proper sending of the shipment.

5. Enervit.ee’s obligations

5.1. Enervit.ee undertakes to deliver a correct and complete order to the Customer.

5.2. Enervit.ee undertakes to accept and document all claims of the Subscriber.

5.3. Enervit.ee undertakes to resolve the Customer’s claim if the reasons for the claim are beyond the Customer’s control. If the cause of the claim is caused by the Customer, the Customer must eliminate it immediately.

5.4. Online Consumer Dispute Resolution Regulation (EU) No. 524/2013

5.5. Disputes concerning contractual obligations arising from online sales or service procurement contracts concluded between a consumer and a trader may be brought to the EU Online Dispute Resolution Platform (“ODR Platform”). The ODR platform is available at: http://ec.europa.eu/consumers/odr/
